Backpacker Tours – Terms & Conditions

Welcome to Backpacker Tours. By booking a tour, transfer, or travel service with us, you agree to the following Terms & Conditions.

1. Bookings All bookings are subject to availability and are only confirmed once Backpacker Tours has issued a booking confirmation.

The person making the booking confirms that they have the authority to accept these Terms & Conditions on behalf of all members of their travelling party.

2. Prices. All prices are quoted in the currency stated on our website or quotation and are subject to change without prior notice until a booking has been confirmed. Unless otherwise stated, prices include only the services listed under "What's Included" for each tour.

3. Payments Payment terms will be communicated at the time of booking. Where payment before departure is required, bookings must be paid by the stated due date to secure the reservation. Where cash payment has been agreed, payment is due upon collection or before the tour commences.

4. Cancellations and Refunds Our Cancellation and Refund Policy forms part of these Terms & Conditions. Please refer to our Refund Policy page for full details.

5. Changes by the Guest Requests to amend bookings will be accommodated where reasonably possible and subject to availability. Additional costs may apply.

6. Changes by Backpacker Tours Backpacker Tours reserves the right to amend itineraries, departure times, routes, accommodation, activities or vehicles where necessary due to operational requirements, weather conditions, road conditions, wildlife movements, safety considerations or circumstances beyond our reasonable control.

Where a significant change becomes necessary, we will make every reasonable effort to provide a suitable alternative.

7. Health and Fitness Guests are responsible for ensuring they are medically fit to participate in the activities they book. Certain activities such as hiking, horse riding, walking safaris and caving require a reasonable level of physical fitness. Guests must inform Backpacker Tours before departure of any medical condition, allergy, disability or dietary requirement that may affect their participation.

8. Guest Responsibilities Guests agree to: ▪︎Follow the instructions of guides, drivers and park rangers at all times. ▪︎Behave respectfully towards local communities, wildlife and fellow travellers. ▪︎Comply with all park rules and conservation regulations. ▪︎Arrive at the agreed departure point on time.

Backpacker Tours reserves the right to refuse participation or terminate a tour without refund where a guest's behaviour places themselves, other guests, staff or wildlife at risk.

9. Wildlife and Adventure Activities Many of our experiences take place in natural environments where wildlife behaves unpredictably.

While every reasonable precaution is taken to ensure guest safety, participants acknowledge that activities such as safaris, walking safaris, hiking, horse riding and caving involve inherent risks. Guests participate voluntarily and agree to follow all safety instructions provided by guides and park authorities.

10. Liability Backpacker Tours exercises reasonable care and skill in arranging and delivering its services.

To the fullest extent permitted by applicable law, Backpacker Tours shall not be liable for; ▪︎Loss, theft or damage to personal belongings. ▪︎Delays or changes caused by weather, road conditions, border delays, government actions, wildlife behaviour or other circumstances beyond our reasonable control. ▪︎The acts or omissions of third-party suppliers, including accommodation providers, national parks, transport providers or activity operators.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded under applicable law.

11. Travel Insurance We strongly recommend that all guests obtain comprehensive travel insurance covering; ▪︎Medical expenses ▪︎Personal accident ▪︎Cancellation ▪︎Personal belongings ▪︎Emergency evacuation where applicable.

Guests are responsible for ensuring their insurance provides adequate cover for the activities booked.

12. Passports, Visas and Travel Documents Guests are responsible for ensuring they possess valid passports, visas, vaccination certificates and any other documentation required for their journey. Backpacker Tours accepts no responsibility for costs arising from incomplete or invalid travel documentation.

13. Photography During tours, photographs or videos may occasionally be taken for promotional purposes. If you do not wish to appear in any photographs or marketing material, please inform your guide before the tour begins.

14. Force Majeure Backpacker Tours shall not be liable for any failure or delay in performing its obligations where such failure results from events beyond our reasonable control, including natural disasters, pandemics, civil unrest, government restrictions, strikes, severe weather or other unforeseen events.

15. Governing Law These Terms & Conditions shall be governed by the laws of the Kingdom of Eswatini.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Eswatini.
